The Empire star had said he was subjected to a homophobic and racist physical attack by two men in January.

Earlier this year, actor and singer Jussie Smollet was said to be the victim of a homophobic and racist attack.

Soon after the news of the attack broke, a number of US media outlets reported that police believed he may have paid two Nigerian brothers to stage the attack.

According to the BBC, one of the brothers in question is Smollett’s personal trainer and both have worked as extras on Empire.

It has now officially emerged that Smollet has been charged with disorderly conduct and filing a false police report.

Chicago Police’s Chief Communications Officer, Anthony Gugliemi, posted on Twitter on Wednesday night to say that detectives were going to make contact with his legal team to negotiate a reasonable surrender for his arrest.

Smollet has not commented since, but his statement at the time of the incident said that he had deep concern with “certain inaccuracies” that had been spread.

“I am not and should not be looked upon as an isolated incident. We will talk soon and I will address all details of this horrific incident, but I need a moment to process.

“Most importantly, during times of trauma, grief and pain, there is still a responsibility to lead with love. It’s all I know. And that can’t be kicked out of me.

“Despite my frustrations and deep concern with certain inaccuracies and misrepresentations that have been spread, I still believe that justice will be served.”
